Terms of Service

Welcome to Recall Vault. By accessing or using our trading journal platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These Terms constitute a legally binding agreement between you and Recall Vault. Please read them carefully.

Governing Law: Laws of England and Wales

Recall Vault provides:

• A digital trading journal for recording and tracking trades
• Performance analytics and insights
• AI-powered trading pattern analysis
• Community features for trader interaction
• Personal trading statistics and gamification elements

Recall Vault offers an optional MetaTrader 5 ("MT5") Expert Advisor ("EA") that sends your trade activity to your Recall Vault account automatically.

• Your responsibility: You are responsible for installing, configuring and keeping the EA running on your own MT5 terminal. We do not have access to your MT5 account password or credentials.
• Data you share: The EA sends trade metadata only (symbol, direction, volume, price, profit/loss, commission, swap, timestamps, and your MT5 account number/broker name). It cannot place, modify or close trades, withdraw funds, or access your broker account beyond the information MT5 exposes to locally-running EAs.
• Token security: Your sync token is unique to your account. Keep it private. If you suspect it has been compromised, regenerate it immediately from Settings.
• No guarantee of sync: Sync depends on your MT5 terminal being open, the EA being attached, your internet connection, and your broker's environment. We are not liable for missed trades, sync delays, or duplicates.

When creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Use the service only for lawful purposes

You must be at least 18 years old to use Recall Vault.

You agree NOT to:

• Use the service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Upload malicious code or viruses
• Harass, abuse, or harm other users
• Post spam, inappropriate content, or financial advice in community areas
• Impersonate other users or entities
• Scrape or automatically collect data from the platform
• Reverse engineer or attempt to extract source code

Violation of these terms may result in immediate account suspension or termination.

Your Content:

• You retain ownership of all trading data, journal entries, and content you create
• You grant us a license to process and display your content as necessary to provide our services
• Community messages are publicly visible and you grant other users the right to view them

Our Platform:

• Recall Vault and all associated intellectual property remain our exclusive property
• You may not copy, modify, or redistribute our platform without permission

Recall Vault is a journaling and analytics tool ONLY. We do NOT provide financial advice, trading signals, or investment recommendations.

• All trading involves substantial risk and may not be suitable for everyone
• Past performance does not guarantee future results
• AI-generated insights are for informational purposes only and should not be considered financial advice
• You are solely responsible for your own trading decisions
• We are not liable for any trading losses you may incur

Always consult with a qualified financial advisor before making investment decisions.

Subscription Service:

• Recall Vault is offered as a subscription service (monthly or annual)
• Subscriptions are billed automatically on a recurring basis via Stripe
• Prices may change with 30 days' advance notice
• All payments are processed securely through Stripe (PCI-DSS compliant)

Refund Policy:

• You may request a full refund within 14 days of your initial purchase
• Refund requests must be submitted via email to support@recall-vault.com
• Upon refund approval, your subscription will be cancelled immediately and access to premium features will end
• Refunds are not available after the 14-day period has elapsed

Cancellation Policy:

• You may cancel your subscription at any time through your account settings
• Upon cancellation, you will retain access to premium features until the end of your current billing period
• No partial refunds are provided for cancelled subscriptions
• Your subscription will not renew after the current billing period ends

Pricing:

All prices are in USD. Applicable taxes may be added at checkout. Receipts are available through your account.

What We Do NOT Exclude: Nothing in these Terms shall exclude or limit our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability which cannot be excluded under UK law

What We Limit (To the extent permitted by UK law):

• Any trading losses or financial damages arising from your use of the platform
• Loss of profits, business, contracts, or opportunities
• Loss or corruption of data
• Service interruptions or unavailability
• Indirect, incidental, or consequential damages
• Damages resulting from third-party actions or services (Supabase, OpenAI, Stripe)

Our total liability to you for any claims arising from or related to the service shall not exceed the total amount you paid to us in the 12 months before the claim arose.

Important: These limitations apply only to the extent permitted by UK consumer protection law. Your statutory rights as a UK consumer are not affected.

We strive to provide reliable service, but we do not guarantee:

• Uninterrupted or error-free operation
• That the service will meet all your specific requirements
• That all bugs or errors will be corrected immediately

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

Your use of Recall Vault is also governed by our Privacy Policy. We are committed to protecting your personal information and maintaining the security of your data.

Either party may terminate this agreement at any time:

• By You: You can delete your account at any time through the settings or by contacting support
• By Us: We may suspend or terminate your account if you violate these Terms or for any other reason with reasonable notice

Upon termination, your access to the service will cease and your data will be deleted according to our Privacy Policy.

We may update these Terms from time to time. Material changes will be communicated to users via email or platform notification. Continued use of the service after changes are posted constitutes acceptance of the updated Terms.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of England and Wales.

Jurisdiction: Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Dispute Resolution: Before initiating legal proceedings, we encourage you to contact us to resolve any disputes informally. If you are a consumer in the UK, you may also have the right to refer disputes to alternative dispute resolution (ADR) services.

UK Consumer Rights: If you are a consumer, nothing in these Terms affects your statutory rights under UK consumer protection law.
